This agreement
These Terms of Service ("Terms") are an agreement between you and the operator of Loloma ("Loloma," "we," "us"). They cover the Loloma apps for iPhone and Android, this website, and the pages Loloma opens for checkout, Spotify connection and video calls (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which explains how we handle your information.
Please read Disputes and arbitration. It says that, with limited exceptions, disputes are resolved by individual arbitration rather than in court, and that you give up the right to bring or join a class action. You can opt out within 30 days.
Who can use Loloma
To use Loloma, you must:
- Be at least 18 years old. We ask for your birthday when you sign up, and we remove accounts we believe belong to anyone younger.
- Be legally able to enter a binding contract, and not be barred from using the Service under US law.
- Not have been convicted of, or pled guilty or no contest to, a felony or any crime involving violence or a sexual offense, and not be required to register as a sex offender anywhere.
- Not have been banned from Loloma before, unless we've told you in writing that you may return.
- Have only one account, and use it only for yourself.
Loloma is offered in the United States.
Your account and verification
- Sign-in. You sign in with Apple, Google or an email address, and verify a mobile phone number by text message. Keep your sign-in details secure. You're responsible for activity on your account, and you should tell us right away if you think someone else has accessed it.
- Verification is required. Before you can see or message anyone, you complete a short live selfie. It is matched to your profile photos and then deleted. The Privacy Policy explains how we handle the face data this involves.
- Your photos must show you. Your profile photos and video intro must be recent and of you. If they stop matching your verified face, your profile is hidden and messaging pauses until you fix it or verify again.
- Be truthful. Give accurate information about yourself, including your age, and keep it up to date. Don't impersonate anyone.
- Your profile goes live once it has at least three photos and passes our content checks.
- Handles. An @handle is optional and can be changed once every 30 days. We may refuse or reclaim handles that are offensive, misleading, look like phone numbers, or infringe someone else's rights.
Community rules
Loloma is for adults looking to meet each other honestly. When you use it, you agree not to:
- Harass, threaten, bully, stalk, intimidate, or demean anyone, or keep contacting someone who has made clear they're not interested.
- Post or send hate speech, or content that attacks people for their race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation or age.
- Post nudity or sexually explicit content on your profile, or send sexual content to anyone who hasn't clearly asked for it.
- Post violent or graphic content, or promote self-harm, illegal drugs or weapons.
- Refer to minors sexually in any way, or bring anyone under 18 onto the Service.
- Offer or ask for sex in exchange for money or anything of value, or advertise paid arrangements, escort services, or adult content subscriptions.
- Ask anyone for money, gift cards, cryptocurrency, investments or financial details, or run any kind of scam, romance fraud or "trading" pitch.
- Put phone numbers, email addresses, social media handles or links on your profile, or advertise or promote any product, service or business.
- Use photos of someone else, AI-generated images presented as you, or a fake identity.
- Share anyone's private information, or their photos, messages or video, without their permission.
- Record, screenshot or share a video call without the other person's permission.
- Use bots, scripts, scrapers or any automated means to access the Service; collect information about members; get around rate limits, filters, blocks or verification; reverse-engineer the apps; use fake or simulated locations; or interfere with how the Service works.
- Create more than one account, sell or transfer your account, or create a new account after we've banned you.
- Break any law, or encourage anyone else to break these rules.
Your content
"Your content" means everything you add to Loloma: photos, video, voice recordings, prompts, your profile, messages and anything else you post or send. You own it.
So that we can run the Service, you give Loloma a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display and transmit your content, and to adapt it as needed for that purpose (for example, resizing photos or transcribing a voice recording for a safety check). This license is only for operating, improving and keeping the Service safe. We won't use your photos or video in advertising without asking you first. The license ends when your content is deleted, except for copies we keep as described in the Privacy Policy, and content you've sent to other members, which they keep.
You promise that you have the rights to everything you post, that it doesn't violate anyone's rights or these Terms, and that everyone recognizable in your photos and video agreed to be there.
We may remove or hide any content that we believe breaks these Terms. We're not required to monitor content, and we're not responsible for what members post or send.
If you believe something on Loloma infringes your copyright, email support@joinloloma.com with the details required by the Digital Millennium Copyright Act: identify the work and the material, include your contact information and a statement of good-faith belief, sign under penalty of perjury that the notice is accurate and that you're authorized to act, and add your physical or electronic signature.
Safety
Verification confirms that a profile belongs to a real person whose face matches their photos. It does not confirm anything else. We don't run criminal background checks or identity-document checks, and we can't verify what people say about themselves. You're responsible for your own interactions with other members, online and in person.
Meeting in person
- Meet in a public place, arrange your own way there and back, and stay in control of your drinks and belongings.
- Tell a friend where you'll be. "Share my date" lets you send your plan to a trusted contact.
- Never send money or financial information to someone you met on Loloma.
- Report anyone who makes you feel unsafe, and contact local emergency services (911) if you're in danger.
Video calls
Video calls are for seeing a match live before you meet. They open once you've both sent a message, require both of you to be verified, and are limited to five minutes per match per day. Calls aren't recorded by Loloma. You can hang up, block or report at any time.
Double dates
When you pair up with a friend, other pairs see both of your profiles together, and a match opens a group chat for all four people. Everything you share in a group chat is visible to everyone in it. You're responsible for inviting only friends who want to be paired with you.
Meetups
Meetups are in-person events listed in the app. Many are run by venues or hosts other than Loloma. We don't control those events, sell their tickets, or guarantee anything about them, including who attends. Follow the same safety habits you'd use on any date.
Moderation, enforcement and appeals
We use automated checks and human review to enforce these Terms. Profiles are checked each time they're saved. Chat photos and voice messages are checked when they're sent. The first messages in a chat are scanned for scam patterns. Repeated reports can automatically pause an account's messaging while a person reviews it. The Privacy Policy describes these checks in detail.
If you break these Terms, we may hide content, give a warning, pause messaging or calls for a period, or ban your account. Every action we take tells you which rule was broken and what content was involved, and you can see it in Settings under Account standing. You can appeal any action once from there, and a person will review your appeal, normally within 72 hours. If a ban is overturned and you were paying for Plus, we refund your unused paid time on a pro-rated basis.
We may act immediately and without an appeal first when we believe someone's safety is at risk, when the law requires it, or for serious violations such as fraud or anything involving minors.
Loloma Plus
The free version is the whole app. Loloma Plus is an optional subscription that adds convenience: unlimited likes, super likes and undos, all deep filters at once, travel mode, and incognito. Features may change over time, and the paywall shows what's included before you buy.
What Plus will never be
- Seeing who liked you is free for every member.
- Nobody can pay to be shown first. Plus status is not part of how profiles are ranked. Every member gets super likes (2 a week on the free version). A super like places you a little above regular likes, only for the one person you sent it to; it never changes how you're shown to anyone else.
- Rank boosts are never sold, and there are no consumable packs of likes, super likes or boosts.
Buying and billing
- You can subscribe on our website through Stripe, in the Android app through Google Play, or through the App Store where that's offered on iPhone. Prices and plan lengths are shown before you buy, and may differ between our website and the app stores.
- Plus renews automatically at the end of each period, at the then-current price, and charges the payment method you used until you cancel. We send an in-app reminder three days before each renewal.
- Purchases through Google Play or the App Store are also governed by Google's or Apple's terms, and those companies handle the payment.
- If we change the price of Plus, we'll tell you in advance, and the new price applies from your next renewal. You can cancel before then.
Cancelling
You can cancel any time. Cancelling stops the next renewal, and Plus stays on until the end of the period you've paid for.
- Bought on our website: cancel from Settings in the app, which opens Stripe's billing page, or email us. Deleting your account also cancels a website subscription immediately.
- Bought through Google Play or the App Store: cancel in your Google Play or Apple account subscription settings. Deleting your Loloma account does not cancel these subscriptions, so cancel there too.
Refunds
Payments are non-refundable except where the law requires a refund, where we've said otherwise in these Terms (such as an overturned ban), or where we choose to make an exception. For app-store purchases, refunds are handled by Google or Apple under their policies. If you live in a state that gives you a right to cancel a subscription and get a refund, you have that right regardless of this section.
Other services
Some features rely on other companies, including Spotify (top artists), GIPHY (GIFs, stickers and clips), Daily (video calls), Stripe (web payments), Apple and Google (sign-in, app stores and device checks). Your use of those features may also be subject to their terms. We're not responsible for their services, and links to other websites are provided for convenience only.
App stores
If you downloaded Loloma from the Apple App Store or Google Play, these Terms are between you and Loloma, not Apple or Google. Apple and Google aren't responsible for the app, its content, maintenance, support, or any claims about it, including product liability, legal compliance or intellectual property claims. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app, if any. To the maximum extent the law allows, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must also follow the app store's own terms of use.
Ending your account
You can delete your account at any time from Settings. It takes effect immediately and can't be undone. The Privacy Policy explains what is removed and the few things that are kept.
We may suspend or end your account, or stop offering all or part of the Service, if you break these Terms, if we're required to by law, if your account has been used to harm others, or if we stop operating Loloma. If we stop offering the Service entirely, we'll give reasonable notice where we can and refund any unused prepaid Plus time bought from us directly.
Sections that by their nature should survive the end of your account will survive, including Your content (for copies others keep), Disclaimers, Limitation of liability, Indemnity, Disputes and arbitration, and Governing law.
Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, Loloma disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that the Service will be uninterrupted, secure or error-free, that you will find a match, or that any member is who they say they are or will behave well.
Loloma doesn't conduct criminal background checks or screen members' histories, and isn't responsible for the conduct of any member, on or off the Service. Matching and compatibility scores are estimates, not guarantees.
Some states don't allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
Limitation of liability
To the fullest extent the law allows, Loloma and its owners, staff and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising from your use of, or inability to use, the Service, or from the conduct or content of any member or third party, on or off the Service, even if we were told such damages were possible.
Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid Loloma in the 12 months before the claim arose, or one hundred US dollars ($100).
These limits don't apply where the law doesn't allow them, including liability for gross negligence, fraud, or intentional misconduct where such limits are prohibited, or for death or personal injury caused by our negligence where such limits are prohibited.
Indemnity
To the extent the law allows, you agree to defend and indemnify Loloma and its owners and staff against any claims, losses and costs (including reasonable legal fees) arising from your content, your conduct with other members, or your breach of these Terms or of the law.
Disputes and arbitration
Talk to us first. Most problems can be fixed quickly. Before starting any claim, email support@joinloloma.com with your name, the phone number or email on your account, and a description of the problem and what you want. We'll both try in good faith to resolve it for 60 days.
Binding individual arbitration. If we can't resolve it, you and Loloma agree that any dispute arising from or relating to these Terms or the Service will be resolved by binding individual arbitration, not in court. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator. It can be held by video or phone, or in person in the county where you live. For claims of $10,000 or less, Loloma will pay the AAA filing, administration and arbitrator fees, unless the arbitrator finds the claim frivolous. The arbitrator can award the same individual relief a court could. The Federal Arbitration Act governs this section.
Exceptions. Either of us may bring an individual claim in small claims court if it qualifies. Either of us may also go to court to stop infringement or misuse of intellectual property, or unauthorized access to the Service.
Class action waiver. You and Loloma may bring claims against each other only individually, not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not combine more than one person's claims.
Opting out. You can opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@joinloloma.com with the subject "Arbitration opt-out," your name, and the phone number or email on your account. Opting out doesn't affect any other part of these Terms.
If the class action waiver is found unenforceable for a particular claim, that claim must be heard in court, not arbitration. If any other part of this section is found unenforceable, the rest still applies.
Governing law
These Terms are governed by the Federal Arbitration Act, applicable US federal law, and the laws of the state in which Loloma's operator is based, without regard to conflict-of-law rules. Consumer protection laws of the state where you live still apply to you where they can't be waived. For any dispute that isn't arbitrated and isn't in small claims court, you and Loloma agree to the jurisdiction of the state and federal courts in the county where Loloma's operator is based, unless the law of your state requires otherwise.
Changes to these terms
We may update these Terms as Loloma changes. We'll post the new version here with a new effective date, and for material changes we'll tell you in the app before they take effect. If you keep using Loloma after a change takes effect, you accept the new Terms. If you don't agree, you can delete your account. Changes to the arbitration section won't apply to disputes we already knew about before the change.
General
- These Terms and the Privacy Policy are the entire agreement between you and Loloma about the Service.
- If any part of these Terms can't be enforced, the rest stays in effect.
- If we don't enforce a part of these Terms right away, we haven't given up the right to enforce it later.
- You can't transfer your account or these Terms to anyone else. We may transfer them as part of a merger, acquisition or sale of assets.
- We're not responsible for delays or failures caused by events outside our reasonable control.
- We may send you notices in the app, by push notification, or to the contact details on your account.
